Practical term for fraud committed in business, covered by Penal Code § 279

Corporate fraud is not an independent legal category in Danish criminal law, but a practical and professional term for fraud and economic crime committed in connection with business activity. The central penal provision is the Danish Penal Code (straffeloven) § 279 on fraud, which covers anyone who, by false or misleading information, withholding of information or similar unlawful conduct, obtains an unjustified gain for themselves or others and thereby causes financial loss to another.

The term is typically used where the fraud occurs in connection with the operation of a business, trade, financial transactions or other commercial activity. It may, for example, cover fraud involving invoices, VAT, accounts, bankruptcy estates or credit information. The criminal-law assessment and classification of the conduct always depends, however, on the specific statutory definitions in the Penal Code, primarily § 279.

The penalty range for fraud under § 279 is imprisonment for up to 1 year and 6 months, but in aggravated cases the penalty may rise to imprisonment for up to 8 years. In assessing the gravity of the offence, factors such as the scale of the criminal conduct, its planned character and its significance for the victim are typically taken into account. Fraud committed in a business context will often be regarded as more serious, particularly where it involves systematic abuse of commercial positions or business relationships.

In practice, corporate fraud may also include or border on other criminal offences such as forgery of documents, computer fraud or violations of special legislation on VAT, accounting or company matters. The overall criminal-law assessment will therefore often involve several provisions, depending on the specific circumstances of the case.
