Crime with a political purpose or motive — no fixed statutory category in Danish law
Political crime denotes offences committed for a political purpose, from a political motive, or in a political context — including acts directed against a state's independence, its constitution or its highest authorities. Under Danish law the term is not a fixed statutory category, but functions as an overarching description of crime in which politics, ideology or state power constitutes a decisive dimension.
In Danish criminal legislation, the closest concrete rules are found in chapter 13 of the Danish Penal Code (straffeloven), which concerns offences against the constitution and the highest state authorities, as well as in the provisions on terrorism. In practice, these provisions regulate the most serious instances of what would journalistically and academically be called political crime.
In a broader, journalistic sense, the term is used about cases in which political power, state intelligence activity or ideological motivation is closely bound up with the offence itself, with the investigation, or with the prosecution. This may involve espionage, state-sanctioned violence, politically motivated killings, or cases in which the authorities themselves are implicated in unlawful acts.
This journalistic concept is clearly reflected in true crime cases such as the execution of the Romanov family during the Russian Revolution, the kidnapping and subsequent radicalisation of Patty Hearst, or the exposure of the double agent Kim Philby — cases in which the boundary between crime and the state's exercise of power is fluid and contested. Common to such cases is that the legal assessment cannot be separated from the political context: who is regarded as perpetrator, victim or hero often depends on which state or ideology defines the premises. This makes political crime a particularly complex field, both legally and historically.
