Definition

An unsolved case is a criminal investigation that remains open because law enforcement has not identified, arrested, or successfully prosecuted the offender. The term is most commonly applied when all probative investigative leads have been exhausted without producing a resolution. The National Institute of Justice defines a cold case as any case whose probative investigative leads have been exhausted, effectively treating it as synonymous with unsolved in practical law enforcement usage.

In the context of federal criminal law, the designation of a case as unsolved does not carry a standalone statutory definition. Rather, the status depends on the investigative and prosecutorial posture of the specific offense. A case remains unsolved if the identity of the perpetrator is unknown, if known suspects cannot be located, or if insufficient evidence exists to support charges or conviction. Federal crimes such as murder under 18 U.S.C. § 1111 have no ordinary statute of limitations, meaning an unsolved federal homicide may remain an active investigation indefinitely.
