serial rapist

A descriptive term in Danish practice, not a separate category in criminal law

Definition

A serial rapist is a person who has committed rape on several occasions, typically over an extended period and often with a recognisable pattern in method, choice of victim or behaviour. Under Danish law, the concept is not defined or regulated as a separate category in criminal law; it is used as a descriptive label in crime journalism, investigation and legal practice. In Danish law, the individual offences are assessed under the provisions of the Danish Penal Code (straffeloven) on sexual offences, in particular § 216 on rape. It is thus the sum of the specific, individual offences — not the perpetrator's classification as a 'serial rapist' — that forms the basis for the charges and the sentence. Repetition of offences may, however, be taken into account as an aggravating circumstance in sentencing.

The term is typically used about offenders who have been convicted of, or are strongly suspected of, a larger number of rapes, and whom the police have identified on the basis of a coherent pattern of offending. In an investigative context, pattern recognition is central: geographical behaviour, victim type, modus operandi and the time intervals between the assaults are analysed in order to link cases to the same perpetrator.

Cases such as those of Paul Bernardo and Joseph James DeAngelo Jr. illustrate the international use of the concept. Both offenders committed a large number of sexual assaults over many years before they were identified and prosecuted. The cases show how serial rapists often operate undetected for a long time, and how modern forensic techniques — including DNA analysis — have been decisive in solving them.

Because 'serial rapist' is a descriptive rather than a legal-technical term, it is used primarily to communicate about the perpetrator's pattern of conduct rather than about a particular concept in criminal law. In the courtroom it is typically replaced by a precise enumeration of the specific offences covered by the indictment.
