While not a formal legal term in U.S. federal criminal law, such environments are prosecuted under the Racketeer Influenced and Corrupt Organizations Act when they meet the statutory definition of a criminal enterprise.

Under RICO, a rocker environment may constitute an "enterprise" when it demonstrates an ongoing organizational structure engaged in a pattern of racketeering activity. This includes activities such as drug trafficking, weapons offenses, extortion, assault, and murder committed to advance the organization's interests. Federal prosecutors have successfully applied RICO to major motorcycle clubs by establishing that the club itself functions as a continuing criminal enterprise, with membership requiring participation in or support of illegal activities.
