EVIDENCE

The Case

The John McAfee case is not a single homicide file but a cluster of separate criminal matters involving the British-American software entrepreneur John David McAfee. It includes a Belizean murder investigation into the death of his neighbor Gregory Faull, an immigration arrest in Guatemala, and a U.S. federal tax-evasion prosecution that ended when McAfee was found dead in a Spanish prison cell in June 2021. Across all three matters, McAfee was never convicted of a violent crime, and the questions surrounding Faull's killing remain formally open.

The Crime

The most serious allegation linked to McAfee concerned the November 2012 shooting death of Gregory Faull, a 52-year-old American citizen who lived two doors down from McAfee's beachside compound on Ambergris Caye, Belize. Faull was found dead inside his home with a single gunshot wound to the head. Belizean authorities quickly turned their attention to McAfee, who had been involved in a long-running dispute with Faull over barking dogs and other neighborhood frictions, as documented in contemporary reporting on the rise and fall of the tech pioneer.

The later U.S. case was of an entirely different character. Federal prosecutors alleged that McAfee earned millions of dollars between 2014 and 2018 through consulting, speaking engagements, cryptocurrency promotion and other income streams, but failed to file income-tax returns for those years. That conduct produced a tax-evasion indictment rather than a violent-crime case.

Timeline

Gregory Faull found dead

Gregory Faull, McAfee's 52-year-old American neighbor on Ambergris Caye, was found dead with a gunshot wound to the head.

5 December 2012

McAfee arrested in Guatemala

After fleeing Belize, McAfee was arrested in Guatemala for entering the country illegally.

31 December 2018

American prosecutors later claimed that McAfee earned millions from 2014 to 2018 without filing tax returns.

5 October 2020

Arrest in Spain

McAfee was arrested at Barcelona-El Prat airport at the request of the US Department of Justice over tax evasion charges.

23 June 2021

Death in Spanish custody

McAfee was found dead in his cell near Barcelona after a Spanish court had approved his extradition to the US; authorities described the death as an apparent suicide by hanging.

The Victims

The only confirmed homicide victim associated with the McAfee story is Gregory Faull, a 52-year-old U.S. citizen who had retired to Belize. Faull was a contractor and bar owner originally from Florida, and according to the Crime Museum's profile of McAfee, he had reportedly complained about McAfee's dogs in the days before his death. No other homicide victim is identified in connection with the McAfee matters.

In the broader picture, McAfee himself can also be regarded as a casualty of the cumulative legal pressure: he died in Spanish custody before any criminal trial could be completed on either side of the Atlantic.

Investigation

Belizean police treated Faull's death as a murder and publicly named McAfee a "person of interest." However, McAfee was never formally arrested or charged for the killing. Instead of cooperating with local authorities, he fled into the Belizean jungle, gave interviews from hiding, and eventually crossed into Guatemala, where he was arrested on 5 December 2012 for entering the country illegally. He was subsequently deported to the United States rather than back to Belize, and the Faull investigation effectively stalled.

The second strand of investigation was driven by the U.S. Internal Revenue Service and Department of Justice. Their key evidence was financial: records purporting to show substantial income from 2014 through 2018 with no corresponding tax filings. Acting on a U.S. extradition request, Spanish police arrested McAfee at Barcelona-El Prat airport on 5 October 2020 as he attempted to board a flight, a sequence summarized in news coverage of the extradition ruling.

Trial and Verdict

There was never a trial in the Faull case. Because Belizean authorities did not bring formal charges, McAfee was never required to answer the murder allegation in court, and he consistently denied any involvement. A civil court in Florida later entered a wrongful-death judgment against him in favor of Faull's estate, but that was a civil matter, not a criminal verdict.

In the U.S. tax case, McAfee was awaiting extradition from Spain when he died. Spanish authorities ruled his death an apparent suicide by hanging in his cell on 23 June 2021, only hours after a Spanish court authorized his extradition. Because he died before being transferred to U.S. jurisdiction, the federal tax-evasion charges were never tested at trial, leaving the case legally unresolved.

Today

The McAfee story remains one of the most unusual intersections of technology, celebrity and crime of the 21st century. The Belize investigation into Gregory Faull's killing has not produced any conviction, and McAfee's own death foreclosed the U.S. tax case. His life, flight and final days continue to be the subject of documentaries, long-form journalism and online speculation, particularly around the circumstances of his death in Spanish custody. For factual purposes, however, the record is clear: McAfee was a person of interest, never a convicted murderer, and the criminal questions surrounding him died with him in a cell near Barcelona in June 2021.
